Op 9 september 2026 is door de Europese Commissie (EC) een ‘Proposal
for a REGULATION OF THE EUROPEAN PARLIAMENT AND OF THE COUNCIL’ (COM(2026) 590
final) gepubliceerd:
Het gaat om een Voorstel voor een ‘Public Procurement Act’, in dit geval een EU-verordening en dus geen EU-richtlijn, die de bestaande Richtlijnen 2014/23/EU, 2014/24/EU en 2014/25/EU herroept en bepaalde EU-verordeningen en EU-richtlijnen wijzigt.
Volgens artikel 1 lid 1 van het Voorstel geldt:
This Regulation establishes rules on public contracts
for works, supplies or services and concessions for works or services procured
by one or more public buyers from one or more economic operators, the value of
which is equal to or greater than the thresholds established in Article 2.
Het gaat dus nog steeds om (de aankoop middels) ‘overheidsopdrachten’, ‘ondernemers’ en ‘aanbestedende diensten’.
In de, volgens het Voorstel, nieuwe openbare aanbestedingsprocedure met mogelijkheid van onderhandeling, de ‘open procedure’, lijkt een door de aanbestedende dienst te hanteren minimum inschrijvingstermijn van tenminste twintig (20) dagen te gelden.
Zie daartoe artikel 34 leden 1 en 2 van het Voorstel:
1. In
the open procedure, public buyers shall make their procurement needs known
through a public summary of competition published pursuant to Article 110
setting out whether and which selection criteria apply, and whether they intend
to negotiate.
2. Any
interested economic operator may express its interest and submit a tender
(‘first tender’) using the electronic eligibility service referred to in
Article 133. The expression of interest shall be submitted together with a
tender specifying in particular how the economic operator proposes to address
the needs of the public buyer. The deadline for receiving expressions of
interest with tenders shall be no less than 20 days from the publication of the
public summary of competition.
Wat zo’n (relatief) korte inschrijvingstermijn na aankondiging van de opdracht praktisch waard is voor hen die minder regels, versimpeling, flexibilisering e.d. in het aanbestedingsrecht voorstaan, moet nog blijken.
Zie namelijk ook het bepaalde in artikel 96 van het Voorstel:
1. When
setting the time limits for expressions of interest or the receipt of tenders
and without prejudice to the minimum and maximum time limits set out in Title I
of this Part, public buyers shall take account of the nature and complexity of
the contract, the necessity of on-site inspections, and the time required for
drawing up tenders.
2. Public
buyers shall extend time limits set for the receipt of tenders in case of
additional information or significant changes. The length of the extension
shall be proportionate to the relevance and complexity of the information or
change.
En ook alle ‘(afgeleide) beginselen’ gelden volgens het Voorstel (nog) onverkort. Zie daartoe bijvoorbeeld Overweging 1:
“The award of public contracts and concessions by or
on behalf of Member States’ authorities has to comply with the principles laid
down in the Treaty on the Functioning of the European Union (the Treaty), and
in particular the free movement of goods, freedom of establishment and the
freedom to provide services, as well as the principles deriving therefrom, such
as equal treatment, non-discrimination, mutual recognition, proportionality and
transparency. For procurement procedures for public contracts and concessions
above a certain monetary value, it is necessary to establish harmonised rules
for procurement procedures so as to eliminate obstacles to the functioning of
the internal market and prevent the emergence of new ones in the form of
regulatory divergences between Member States, including as regards the pursuit
of strategic policy objectives. […]”
