Op 9 september 2026 is door de Europese Commissie (EC) een ‘Proposal
for a REGULATION OF THE EUROPEAN PARLIAMENT AND OF THE COUNCIL’ (COM(2026) 590
final) gepubliceerd:
Het gaat om een Voorstel voor een ‘Public Procurement Act’, in dit geval een EU-verordening en dus geen EU-richtlijn, die de bestaande Richtlijnen 2014/23/EU, 2014/24/EU en 2014/25/EU herroept en bepaalde EU-verordeningen en EU-richtlijnen wijzigt.
Volgens artikel 1 lid 1 van het Voorstel geldt:
This Regulation
establishes rules on public contracts for works, supplies or services and
concessions for works or services procured by one or more public buyers from
one or more economic operators, the value of which is equal to or greater than
the thresholds established in Article 2.
Het gaat dus nog steeds om (de aankoop middels) ‘overheidsopdrachten’, ‘ondernemers’ en ‘aanbestedende diensten’.
In hoofdstuk 3 van het, tot het Voorstel behorend, ‘EXPLANATORY MEMORANDUM’ van de EC staat onder het kopje ‘Regulatory fitness and simplification’ vermeld:
“The proposal
simplifies the legal framework by replacing the three existing Directives with
a single directly applicable Regulation. This reduces fragmentation, removes
divergences resulting from national transposition, and provides a more coherent
and accessible set of rules for public buyers and economic operators. It also
streamlines the procedural framework by reducing the number of procedures and
establishing more flexible and operational tools adapted to different
purchasing needs.”
Het is dan ook vreemd, dat de huidige, geconsolideerde, Rechtsbeschermingsrichtlijn 89/665/EEG geen plaats heeft gekregen in het Voorstel.
En dat zou dus betekenen, dat de door de EC beoogde ‘Public Procurement Act’ (toch) leidt tot een Nederlandse Aanbestedingswet.
